
REAL ESTATE TERMS AND CONDITIONS
Preparing the property for photography:
It is the duty of the agent and/or seller to properly prepare the home for photographs. Please clean and de-clutter the property prior to the appointment. All services such as painting, power washing, cleaning, carpet steaming, repairs, landscaping, lawn care, staging, appliance delivery, etc. should be done prior to the appointment. Please remove trash bins, vehicles, and signs from exterior of the home. Vehicles should be pulled in the garage or parked in the street a couple houses down, if possible.
Salt Lake Real Estate Photography shall not be responsible for photographs not taken as a result of the client's failure to provide reasonable assistance or cooperation.

Payment Policy:
​
Due to the fast turn around time, short booking notices, and the "quick transaction" nature of real estate photography, invoices are expected to be paid within 48 hours of the final product being delivered. Any media being used before the invoice is paid is considered unauthorized use, theft of intellectual property, and will be addressed as such.

Delay policy:
In an effort to ensure Salt Lake Real Estate Photography is on time for all scheduled appointments, any delays experienced due to the property not being prepared on time, will be rescheduled and assessed a $50 fuel fee.
Cancellation Policy:
Appointments must be cancelled within 24 hours of the appointment to avoid a cancellation fee of $50.
This fee will not be assessed if an appointment is cancelled due to inclement weather.

Doorstep Cancellation Policy:
If an associate of Salt Lake Real Estate Photography is unable to obtain access to a property at the time of the appointment due to the absence or lack of cooperation of a seller/host/agent/tenant/etc, a 100% fee will be assessed.

SHOOTING TIME / ADDITIONS: the photo shoot schedule and selected methodology are designed to accomplish the goals and wishes of the client in a manner enjoyed by all parties. Clients and Salt Lake Real Estate Photography agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time. Any delay due to painting, carpet steaming, cleaning, power washing, landscaping, or maintenance will result in a reschedule and a travel fee of $50 will be assessed

Copyright Ownership and Use:
In exchange for services provided, Salt Lake Real Estate Photography retains the right to sell, copy, display, and/or publish any/all images created under this agreement, to the general public, for any reason. Unless otherwise specified, all media created is owned by Salt Lake Real Estate Photography and Salt Lake Real Estate Photography is the copyright holder.

Unless otherwise noted, the client is granted permission to use the media created for the purpose of promoting and selling a specific property, home, unit, or vessel.

Permission to use media created by Salt Lake Real Estate Photography is not the same as owning the copyright.

Use of media created is granted to a specific client or clients indicated on the invoice. A closed or paid invoice permits the client to use the images for the purpose of promoting and/or selling a specific property.

Sending final images to third party editing services such as Box Brownie is strictly prohibited. I will be happy to provide any adjustments needed to the final images.

Any media created by Salt Lake Real Estate Photography cannot be reproduced, redistributed, or resold without the written permission of the copyright holder (Salt Lake Real Estate Photography)
An invoice payment that is declined, refunded, or sent a chargeback is not a paid or closed invoice. Use of any media associated with that invoice after an invoice has been declined, refunded, or sent a chargeback is considered theft of intellectual property.
LIMITS OF LIABILITY:
While every reasonable effort will be made to produce and deliver outstanding photographs, because sometimes there are uncontrollable events, the photographer cannot guarantee delivery of any specifically requested image(s).
Drone / Aerial Photography & Video
FAA Compliance:
All drone operations performed by Salt Lake Real Estate Photography are conducted in accordance with Federal Aviation Administration (FAA) regulations, including Part 107 requirements. Salt Lake Real Estate Photography reserves the sole and absolute right to determine whether a drone flight can be safely and legally conducted at the time of the appointment.

Airspace, Weather & Safety Limitations:
​
Drone services are subject to airspace restrictions, temporary flight restrictions (TFRs), weather conditions, visibility, wind speeds, nearby people or structures, equipment functionality, and other safety-related factors.
Salt Lake Real Estate Photography may delay, modify, or cancel drone operations if conditions are deemed unsafe or non-compliant with FAA regulations. No guarantees are made regarding specific aerial angles, elevations, or compositions.
If a drone flight cannot be completed due to weather, airspace restrictions, FAA limitations, safety concerns, or circumstances beyond the photographer’s control, the drone portion of the service may be rescheduled or refunded at Salt Lake Real Estate Photography’s discretion. Any ground-based photography or videography services completed will remain billable.
Weather Rescheduling:

Drone flights are particularly weather-sensitive. High winds, precipitation, low visibility, smoke, or rapidly changing conditions may require last-minute rescheduling. Weather-related drone cancellations will not incur a cancellation fee for the drone portion of the service.

Neighboring Properties & Property Lines:
Drone imagery may incidentally capture neighboring properties, structures, or land features. Removal, blurring, or retouching of adjacent properties, boundaries, or identifying features is not included unless specifically requested and agreed upon in writing.
Salt Lake Real Estate Photography does not guarantee exclusion of neighboring properties, streets, or people from aerial imagery.
Privacy & Legal Disclaimer:
All aerial imagery is captured from legal navigable airspace and in compliance with applicable laws and FAA regulations. Salt Lake Real Estate Photography assumes no responsibility for privacy, nuisance, or trespass claims arising from lawful drone operations.
The client agrees to indemnify and hold harmless Salt Lake Real Estate Photography from any claims, complaints, fines, or legal actions arising from client misrepresentation, lack of permission, or unauthorized use of drone imagery.
Indemnification
The client agrees to indemnify, defend, and hold harmless Salt Lake Real Estate Photography, its owners, employees, contractors, and affiliates from any and all claims, damages, liabilities, penalties, or expenses arising out of drone services requested by the client, except in cases of gross negligence or willful misconduct.
Limitations of Liability (Drone Services)
Salt Lake Real Estate Photography shall not be liable for the inability to capture specific aerial images due to FAA restrictions, weather, safety conditions, equipment malfunction, or other circumstances beyond reasonable control.
